Investigation uncovers employer health tax evasion

Charges lead to more than $23,000 in fines

    WHITBY, ON, June 19 — A Ministry of Revenue investigation revealed
that over a five-year period Apex Quality Services Ltd. failed to report and
pay $76,059.34 in Ontario employer health tax (EHT).
    The company, which provided automotive inspection services, has been
fined $19,000 for failing to report and pay EHT between 1999 and 2004.
    On June 4 Apex Quality Services Ltd. pleaded guilty to the evasion of
employer health tax. It was ordered to pay the fines and must also pay
surcharges of $4,750 to the Ontario Victims' Justice Fund, bringing the total
court-imposed penalties to $23,750.
    The Ontario Ministry of Revenue operates a Voluntary Disclosure Program.
Corporations and individuals may come forward and voluntarily report past
violations of provincial tax laws and pay any amount owing. Prosecution and
civil negligence penalties are waived in such cases. To qualify for immunity
from prosecution and penalties, however, a disclosure must be voluntary - it
cannot be prompted by a request for access to a taxpayer's business records or
other ministry enforcement action.
