Markham Business Fails To Pay More Than $200,000 In Sales Tax
President Fined $100,000 For Violating Retail Sales Tax Act
RICHMOND HILL, ON, Aug. 31 — A Markham corporation, known as
Father's Steak House & Pub, collected $235,857 in sales tax that it failed to
send to the province.
On June 22, 2007, 1244452 Ontario Limited, located on McCowan Road in
Markham, was convicted of failure to remit retail sales tax it had collected
over a two-year period. The corporation's president, William Roskar, pleaded
guilty to participating in the offence.
Roskar was fined $100,000 for his role and must pay a surcharge of
$20,000 to the Victims' Justice Fund. The corporation was given a suspended
sentence.
In addition to court-imposed fines and surcharges, businesses convicted
of tax offences must repay any taxes owing, plus civil negligence penalties
and interest. 1244452 Ontario Limited has since paid $37,000 toward the
company's civil tax liability.
The Ministry of Revenue operates a voluntary disclosure program.
Corporations and individuals may come forward and voluntarily report past
violations of provincial tax laws and pay any amounts owing. Prosecution and
civil negligence penalties are waived in such cases. To qualify for immunity
from prosecution and penalties, a disclosure must be truly voluntary - it
cannot be prompted by a request for access to a taxpayer's business records or
other ministry enforcement action.
